AVYX PRIVACY POLICY PROTECTION AND PROCESSING OF PERSONAL DATA

1.1. Legislation. All processing of personal data takes place in accordance with the General Regulation of the European Union No. 2016/679, on the protection of personal data) (hereinafter referred to as "GDPR").

1.2. Processing of personal data for the fulfilment of the contract and in connection with the concluded contracts. We process your personal data on the basis of and for the purpose of fulfilling our obligations arising from the contracts concluded between us and you and for the conclusion of these contracts. For this purpose, we use personal data for the time necessary to process orders and complaints. As part of these activities, your personal data may be made available to other entities (in particular, our suppliers participating in the performance of the contract and operators of payment systems). On the basis of the contract, we also process your personal data when maintaining user accounts in our online store for the entire duration of the user account.

1.3. Processing of personal data for sending commercial messages. We also process your personal data for the purpose of further offering our goods and services through commercial communications based on our legitimate interest, unless you have refused this sending.

1.4. Processing of personal data based on legitimate interest. We process your personal data on the basis of our legitimate interests for the purpose of protecting legal claims and our internal records and control, for the duration of the limitation period and one year after its expiry with respect to claims made at the end of the limitation period. In the case of judicial and other proceedings, we process your personal data to the extent necessary for the entire duration of such proceedings and the remaining part of the limitation period after its termination.

1.5. Processing of personal data based on consent. Based on your consent granted for an indefinite period, we also process your personal data for the purpose of:

1.5.1. sending personalized offers of goods and services and offers from other entities and displaying them on the website.

1.6. Processing of personal data for the fulfilment of our legal obligations. We also process your personal data for the purposes and on the basis of the fulfilment of our legal obligations connected, in particular, with keeping accounts and providing information to public authorities.

1.7. Scope of personal data processing. The personal data we process are:

1.7.1. name and surname,

1.7.2. birthdate,

1.7.3. address,

1.7.4. email address,

1.7.5. telephone number,

1.7.6. identification number and tax identification number,

1.7.7. IP address,

1.7.8. mutual communication data,

1.7.9. order and transaction data.

1.8. Use of cookies. When using our online store, cookies may be stored on your device. You can refuse their use at any time by setting your device accordingly.

1.9. Disagreement with the processing of personal data. You can at any time express your objection to the processing of your personal data for the purpose of sending commercial communications, just as you can at any time revoke your previous consent to the processing of personal data for another purpose, unless it is processing for the purpose of fulfilling our obligations arising from contracts, for the purpose of fulfilling our legal obligations or other purpose arising from our legitimate interests.

1.10. Storage time. We store personal data only for the time necessary to achieve the purposes listed above. After the purpose of the processing ceases, we will immediately dispose of the personal data.

1.11. Persons involved in processing. All mentioned personal data are processed by us as the administrator. This means that we determine the above-defined purposes for which we collect personal data, determine the means of processing and are responsible for its proper execution. For the processing of personal data, we also use the services of other processors who process personal data only according to our instructions. Such processors are mainly providers of IT services and other suppliers of technology and support, operators of marketing tools and providers of communication tools.

1.12. Rights of the subject of personal data. In relation to your personal data, you also have the right to:

1.12.1. request the correction of inaccurate or out-of-date personal data, so if you find that the personal data we process about you is inaccurate or incomplete, you have the right to have it corrected or supplemented without undue delay,

1.12.2. request confirmation of whether processing is taking place, and if it is, information regarding this processing to the extent set out in Article 15 of the GDPR, as well as a copy of the processed data (for additional copies, we are entitled to charge a fee designed to cover the necessary costs),

1.12.3. in some cases, you have the right to have your personal data deleted. We will delete your personal data without undue delay if we no longer need it for the purposes for which we processed it, or if you exercise your right to object to the processing and we find that we no longer have any legitimate interests that would justify this processing, or will show that the processing of personal data by us has stopped.
